COVID-19 - Return to In-Person Hearings

Effective November 1, 2021, the Court of Appeal will resume in-person proceedings for all appeal sittings and applications before three-judge panels.

An update on how the Court will be conducting applications before a single judge, Appeal Conferences, Appellate Judicial Dispute Resolution and Bar Admissions after November 1, 2021 will be provided in a separate notice at a later date.

In accordance with the Court’s announcement on March 23, 2020, Use of Electronic Proceedings for Appeals, Applications and Motions, all appeal sittings and applications before three-judge panels as well as all single judge matters scheduled before November 1, 2021 will proceed electronically by videoconference or teleconference. The current processes and guidelines for electronic hearings set out in the March 23 and July 6, 2020, Notices to the Profession and Public will continue to govern. Parties with an appeal or application before a three-judge panel scheduled to be heard electronically in September and October but who would prefer to wait until after November 1 to have an in-person hearing may submit a rescheduling request to the relevant Case Management Officer. Such requests will be subject to the availability of hearing dates.

For the safety of all Court participants, the public health safety measures of restricted access to, and mandatory masks in, courthouses will continue to apply until further notice in accordance with the Notice dated June 25, 2021.
