Filing, Fees and Forms

General Information

Before commencing an appeal, we recommend that you review the following:

Registry staff are not lawyers and cannot give you legal advice.

If the matter you are appealing was heard in Calgary, Drumheller, Lethbridge, Medicine Hat or Red Deer you must file your appeal documents at the Registry in Calgary.

If the matter you are appealing was heard in another Alberta location you must file your appeal documents at the Registry in Edmonton.

Before filing a document, we recommend that you familiarize yourself with the following:

On August 31, 2020, the Court of Appeal implemented CAMS (Court of Appeal Management System). CAMS is a case management, document management and electronic filing system designed to better serve the administration of justice, litigants, the Bar and the public at large. It automates many of the Court’s procedures and permits lawyers and litigants to initiate an appeal, file materials and pay applicable fees electronically. In addition, once registered, users can access the electronic court file for their own cases and view other information about their appeals including the full text of all filed documents, deadlines, hearing dates, results and more.

To register for a CAMS account, you must be a lawyer, work in a law firm or be a self-represented litigant with a matter before the Court of Appeal. Accounts are not available to the media or members of the public.

Electronic documents have different formatting requirements than paper documents. All documents filed electronically must adhere to the formatting requirements set out in the Practice Direction on Electronic Filing. If a document is filed electronically, a paper copy need not be filed.

Fees

Civil Appeals

The following filing fees are applicable to civil matters:

Notice of Appeal $600
Application for Permission to Appeal – Commencement Document $600
Application for Permission to Appeal – Non Commencement Document $50
Application to Restore an Appeal (including consent orders/letters) $200 – first restoration
$500 – second restoration
$1000 – third and subsequent restoration
All other applications $50

Criminal Appeals

Filing fees are not payable in criminal matters.

Civil and Criminal Appeals

Search fees $10 per search
Photocopying/fax fees $1 per page
Certification of a document $10 per document

Payment may be made by cash, Visa, MasterCard, American Express, Interac Debit, certified cheque or money order. Certified cheques and money orders are payable to the Government of Alberta. In compliance with Credit Card Industry Standards, credit card payments over the phone or via fax or email cannot be accepted.

Payment of the applicable fee must be made before the document will be processed for filing.
