Electronic Without Notice Desk Applications - Family Matters

The Court is now processing electronic Without Notice Applications in Family matters in one of the following two ways, based on urgency:

1. Matters that are Not Urgent (including but not limited to applications for exemption from Parenting After Separation course or from attendance before a Dispute Resolution Officer/Child Support Resolution Officer, and Fiats that are not time sensitive): The process for Without Notice Desk Applications in Justice Chambers will apply. Those provisions and access to the Without Notice Desk Application Form are repeated here for ease of reference.

Without Notice Desk Application

For those applications that may be made ex parte or without providing notice to a Respondent, the Applicant must submit: (1) any material in support of the Application, including an Affidavit or other evidence; and (2) the proposed Form of Order being sought in accordance with the email filing instructions here.

The response to the Application will be returned by email, including: the electronically signed Order with an Endorsement setting out brief reasons; or an Endorsement requiring additional information or indicating the Justice's reasons for denying the Application.

Those Applicants unable to submit their application by email may continue to file in paper at the appropriate Judicial Center.

This notice does not change the requirement that, where a Master has jurisdiction and is available, applications should be made to Masters Chambers.

2. Matters that are Urgent (including but not limited to applications for restraining orders, Queen's Bench Protection Orders, urgent parenting orders where a child is in danger or has been taken or is being withheld, preservations orders, and time sensitive Fiats): The Applicant may appear in remote regular Family Chambers by Webex (Webex address for Family Chambers is posted on the Court’s Website here and the Applicant must sign on 15 minutes before Chambers begins). Outside of regular Chambers sittings, the Applicant may apply to the Emergency Duty Justice assigned that day. The name of the Emergency Duty Justice can be determined by contacting the local Clerk’s Office at: https://www.albertacourts.ca/qb/about/locations-and-sittings.

The Applicant should provide a form of Order and any material in support of the Application, including an Affidavit or other evidence. The proposed Form of Order and any other materials being relied upon shall be provided to the Clerk’s office in accordance with the email filing instructions here. Where an Applicant does not have Counsel, the Court may give directions for an Order to be completed by the Court Generated Orders Clerk.

Applicants who do not have access to technology to participate in remote regular Family Chambers may continue to file and appear in person.
