Effective April 9, 2025, the King’s Bench Filing Digital Service – Civil will expand digital order capabilities to accept consent orders.
What is digital consent?
Digital consent allows lawyers to easily consent to proposed digital orders on behalf of their clients without needing to apply a signature to a paper or PDF document.
Eligible orders
Digital consent can be used for any Applications Judge desk application accepted through the King’s Bench Filing Digital Service – Civil.
How it works
Lawyers or legal assistants draft digital consent orders, provide contact information, and request consent through the digital service. Preparing and responding lawyers receive an email with a link to where they can easily consent on behalf of their clients without needing to apply a signature to a paper or PDF document.
Highlights
Lawyers only: At this stage, the system only supports lawyers consenting on behalf of clients. If self-represented individuals are consenting, the status quo PDF process should be followed.
- All parties must respond: Even if the preparing lawyer initiates the request (rather than a legal assistant), they must also click the link and confirm their responses.
- Resend requests: If contact information is incorrect or a responding lawyer declines consent by mistake, the request can be updated and sent again.
- Order edits: The system does not facilitate the preparation of the order contents. Should changes need to be made to the order the preparing lawyer must be contacted outside of the digital service.
While it is not mandatory, lawyers and legal assistants are encouraged to use the new functionality whenever possible.
