Family Law - Financial Disclosure

Jan 25, 2016

At its meeting on December 9th 2015, the Court of Queen’s Bench Executive Board approved a number of short term measures to improve the current family law financial disclosure application process. Currently, these disclosure applications and adjournments consume 30% of the morning family chambers docket. Reducing the need for these applications allows the Court to achieve better lead times for morning chambers and free up judicial time for use in other areas.

Accordingly, the Court intends to adopt an improved process to ensure that disclosure is provided in a fulsome and timely manner prior to hearing the application. As a first step, the Court will begin strictly enforcing s. 21 of the Federal Child Support Guidelines and s. 21 of the Alberta Child Support Guidelines. (Section 21 ensures that parents disclose the relevant financial information - Please consult these sections for the required income information.)

The Court will advise of further proposed process improvements prior to their implementation. If you wish to provide input, please send your comments to disclosure.qb@albertacourts.ca.
