Effective February 6, 2025, the Court of King’s Bench Filing Digital Service (Civil & Chambers) will expand digital order capabilities to include more ex parte (without notice) orders.
What digital orders can be submitted?
Lawyers and legal assistants can now create digital orders using a generic order form that has no pre-determined clauses. Submissions must meet the following criteria:
This is in addition to the already offered capabilities for subsequent civil filings, Applications Judge’s desk applications for Orders for Substitutional Service.
Digital orders pertaining to the following are not accepted:
- Chambers applications
- Consent orders
- Desk applications to Justices
- Proposed orders that start an action
- Pronounced orders
More order types will be available soon.
What is a digital order?
A digital order is created by filling out an online form instead of uploading a PDF.
Once finalized, a digital order can be attached and submitted as part of a filing request. If needed, it can be easily edited by a Justice or Applications Judge prior to signing.
What are the benefits?
Digital orders facilitate processes that are difficult or impossible with PDFs. They are intended to:
- Decrease chance of rejection
- Improve efficiency
- Speed up processes
While it is not mandatory, lawyers and legal assistants are encouraged to use the new functionality whenever possible.
