Effective Dec. 9, 2024, Alberta lawyers and legal assistants will have the ability to restore sine die matters to the Morning Civil Justice Chambers list through the Civil Filing Digital Service.
To restore your matter, you are required to submit a Restore Letter, which should include the following details:
- The action number
- The date the application was originally filed
- A description of the application
- The requested hearing date
Additionally, you must submit any previously-filed documents that you intend to rely on during the hearing, as supporting documents with the Restore Letter submission. This includes, but is not limited to, the statement of claim, the application, affidavits, affidavits of service, and any documents served upon you for the hearing.
The Restore Letter must be served on the opposing party at least five (5) days prior to the hearing. An Affidavit of Service should also be filed.
Please ensure that all necessary documents are properly submitted and served in accordance with the requirements outlined above.
The Filing Digital Service can be accessed at: https://qb-filing.alberta.ca.
Please note that for matters to be restored to the Application Judges' Chambers or Family Law Chambers list, counsel should continue submitting their requests to the KB Filing proxy for that specific center. The guidelines outlined above must still be followed. The email filing proxies can be found here:
